Droombos, an accommodation, conference and restaurant estate in Windhoek, has been ordered by the High Court to stop hosting events on its premises.
The order was made in a judgement delivered by judge Nate Ndauendapo on Friday, after the Windhoek municipal council applied for a court order against the company Hallie Investment Number 582, which owns Droombos.
The City of Windhoek alleged that Droombos has been hosting unauthorised events and disturbing neighbouring residents with excessive noise.
In his judgement, Ndauendapo found that Droombos only has a permit to operate a a guest house and conference facilities.
“Contrary to the consent use, [Droombos] hosts events and functions,” Ndauendapo stated.
The City of Windhoek also wanted the court to limit the level of sound coming from Droombos. However, the court did not grant that request, after finding that there is no law that regulates that.
“There is no legislative framework dealing with ambient sound level and the reliance by the applicant [municipal council] on ambient sound level to seek,” Ndauendapo said.
Hallie Investment Number 582 is a subsidiary of the Safland Property Group and is run by Meghan van der Merwe, a daughter of Safland founder Kallie van der Merwe.
