JASON Shikambe and Fabianus Shekunyenge, two inmates from the Hardap Correctional Facility, have filed a lawsuit against the Minister of Home Affairs, Immigration, Safety and Security, the Police General, and two officers for N$1.4 million over the violation of their dignity.
In the details outlined in their legal claim, the incarcerated individuals emphasized that the two officers, referring to them only as Amushila and Louw, infringed on their constitutional rights to human dignity. This violation, they expressed, occurred when these officials denied them the opportunity to formally register a complaint they had previously submitted at a police station.
In November of 2021, Shikambe claimed to have been refused the opportunity to file criminal charges concerning the theft of his eyeglasses at the Mariental police station. Similarly, Shekunyenge allegedly faced obstacles when attempting to report an assault against an officer of the Hardap Correctional Facility.
The two inmates further pointed out that Shekunyenge was further refused an opportunity to open a case after being assaulted by members of the correctional facility on 7 and 11 October 2021, which, according to them, violated their constitutional rights to human dignity.
As a result, they cited, the government must compensate them for the damage they endured in the amount of N$1.45 million and the cost of the suit.
Judge Herman Oosthuizen presided over this special plea in the High Court of Namibia, and the ruling is anticipated to be delivered on September 15, 2023.
